Terms of Use

What you can expect when you use this site, and what we ask in return. Plain English. Legal-adjacent but not legalese.

1. Use

You can read, link to, and quote from this site freely. We ask that you credit us when you quote at length and that you don't misrepresent our stated practices or numbers.

2. Ledger accuracy

The Tank Ledger is drawn from our in-house records and updated continuously. We publish in good faith but can't guarantee zero typos. If you find an error, email the yard and we'll fix it within one business day.

3. Quotes

Prices on this site are indicative. A firm quote is whatever is written in the email reply you receive after submitting a form. Until then, treat numbers here as estimates.

4. Applicable law

Disputes are governed by the laws of the Commonwealth of Pennsylvania. Venue is Allegheny County.

6. Orders and acceptance

An order is considered accepted when we send you an email reply confirming a specific tank count, a specific grade, a specific price, and a specific delivery or pickup window. Estimates on the website, quote PDFs not yet countersigned, and verbal conversations at the yard do not constitute an accepted order. An accepted order can be modified or canceled by either party, in writing, up to 24 hours before the confirmed dispatch time. After that, we reserve the right to charge a restocking fee equal to the freight already committed.

7. Payment terms

Default terms are payment on delivery for new accounts, and established-account terms for repeat customers (three or more clean transactions). We accept cash at pickup, ACH, check, and major credit cards through our processor. Credit card transactions carry a processing surcharge; all other methods are at face value. Past-due balances accrue interest at the maximum rate allowed by Pennsylvania statute. We do not invoice for small trailing amounts — under-run and over-run amounts are reconciled on the following invoice.

8. Grading & warranty

Tanks are sold graded A, B, C, or Rebottled, as described on our Grading System page. We warrant that every delivered tank matches its stated grade at the time of delivery. If a tank does not match its stated grade, the exclusive remedies are (a) replacement with a same-grade tank at our cost, or (b) a refund of the purchase price of the affected tank. This warranty is void if the tank has been modified, painted, re-piped, or stored outside the parameters described in our Size & Spec Guide. We disclaim any implied warranty of merchantability or fitness for a particular purpose beyond the stated grade.

9. Delivery & risk of loss

Risk of loss transfers to the buyer at the moment a tank is unloaded from our truck onto the buyer's premises, or at the moment it is handed off to a carrier the buyer has nominated. For our own fleet, we carry commercial cargo insurance on every load. Buyer is responsible for ensuring a safe, legal unloading location with forklift access, a 48" × 40" footprint per tank, and overhead clearance of at least 80" for full units. Unreachable delivery addresses may incur a re-delivery fee.

10. Buyback service

When we purchase tanks from you, a separate set of terms applies: tanks must be RCRA-empty, residue must be identifiable, and payment is issued within 10 business days of final weigh-in. We reserve the right to re-grade or decline individual tanks based on intake inspection. If a tank is declined for residue contamination that you failed to disclose, we may invoice you for the cleanup or disposal cost. 11. Intellectual property

All content on this site — articles, photographs, tables, the ledger visualization, the grading rubric, and our site design — is copyrighted by Pittsburgh Totes Recycling. You may link to any page and quote up to 200 words with attribution. Reproducing full articles or lifting the grading rubric for commercial use requires written permission. Our logo and yard photography may not be used to imply endorsement without our written consent.

12. Limitation of liability

To the fullest extent permitted by Pennsylvania law, our total liability under any order is limited to the amount you paid for the specific affected tank or tanks in the most recent order. We are not liable for indirect, incidental, consequential, or punitive damages — including lost profits, production downtime, or spoilage of product stored in a tank — arising out of the sale, use, or recycling of an IBC. This limitation does not apply to personal injury caused by our gross negligence or willful misconduct.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of: (a) your misuse of a tank for a purpose its grade does not cover; (b) your failure to follow published handling or stacking guidance; (c) your storage of a substance incompatible with the gasket or HDPE material of the tank; and (d) any misrepresentation by you of residue contents on an incoming load.

14. Dispute resolution

Any dispute that cannot be resolved through direct email correspondence will first be submitted to non-binding mediation in Allegheny County before any lawsuit is filed. If mediation fails, venue for any litigation is the Court of Common Pleas of Allegheny County, Pennsylvania. Each party bears its own attorneys' fees unless a court finds a claim was brought in bad faith.

15. Force majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control: severe weather, regional flooding on the Ohio River corridor, PennDOT closures of I-79 or I-376, power outages, labor actions at upstream suppliers, or a pandemic-level public health event. We will notify you as soon as we know of a material delay.

16. Severability & entire agreement

If any provision of these terms is held unenforceable, the remainder remains in effect. These terms, together with any written order confirmation, constitute the complete agreement between us concerning the sale, purchase, or service of IBC totes. Prior verbal statements are superseded unless restated in the order confirmation.

17. Changes to these terms

We may update these terms as our practices evolve. The current version always appears on this page, dated at the foot. Orders placed before a change are governed by the version of the terms in effect on the order acceptance date. Material changes are summarized on our sitemap changelog.
